What is mediation?
Mediation is a process where a neutral person, the mediator, helps people in conflict talk things through and work towards a solution that suits everyone. The mediator doesn’t make decisions for you, take sides, or to provide legal or personal advice. Instead, they guide the conversation and help you find common ground.
Do I need to hire a lawyer for mediation?
No, you don’t have to have a lawyer for mediation, however, you can choose to have your lawyer attend the mediation. Many people come on their own. But if you’d like support or want legal advice before or after the session, that’s totally fine too. Some people find it helpful to check in with a lawyer before signing any agreement.
How long does mediation usually take?
It really depends on the situation. Some mediations are wrapped up in a couple of hours, while others might take a full day or a few sessions. Your mediator can give you a better idea of timing once they know what your dispute is about.
What happens if we can’t reach an agreement in mediation?
If you don’t reach an agreement, that’s okay. You still have other options, like negotiation, arbitration, or taking the matter to court or the Disputes Tribunal. Even if the mediation doesn’t solve everything, it often helps people understand each other better and narrow down the issues.
Is what we discuss in mediation confidential?
Yes, absolutely. Mediation is a private and confidential process. What’s said in the room stays in the room, it can’t be used later in court (except in very rare situations, like safety concerns). This confidentiality helps everyone speak openly and honestly
Can the mediator make decisions for us?
No, the mediator doesn’t make decisions or tell you what to agree to. Their job is to help you talk through the issues and support you in finding your own solutions. Any agreement you reach is entirely up to you.
What kinds of disputes can be resolved through mediation?
Mediation can help with all sorts of disagreements – from family or relationship issues to workplace, business, property, or community disputes. Basically, if you’re in conflict and want to sort things out without going to court, mediation is a great place to start.
